Legal Services At Inter Canada Credit, we believe that legal action should never be a first option for debt recovery. However if the debtor does not respond to our voluntary resolution methods then we have a full service legal department ready to serve your needs. We have an on staff paralegal and an in house lawyer to advise our collection department on any legal matters relating to our client's accounts. Between them, they have many years of successful debt recovery litigation in both Ontario Small Claims and Ontario General Division Court. Every file considered for legal action will first be reviewed by our legal department to ensure that judgment can be obtained and the debtor has the means to pay their debt. If the debtor has wages that can be garnished or property or assets that can be seized for sale, then action will be recommended. Obtaining judgment is not enough if your claim cannot be recovered and we would not recommend throwing good money after bad on an action that would not get your account paid. No legal action is ever undertaken without the expressed written consent of our client. This will be after our legal department has reviewed the file with our client and we have outlined the possible chances of winning your claim and the related costs for litigation. We are committed to providing a service that put your best interest first and the client always has the final determination if a file should be sued or our debt recovery processes should be continued. Unlike most collection agencies, our commission rates do not increase for files that you wish us to sue on your behalf. The commission rate remains the same regardless of whether the funds are collected by our collection department or by our legal department. The clients who wish us to take legal action on their behalf will be required to provide a retainer before we file the claim, but this will be discussed during our consultation with you regarding your account. In most cases the court costs are recovered by adding them to the debtor's claim at the time of filing and making a motion to include any further costs, incurred after filing the claim, when judgment is rendered. l For Ontario Small Claims Court actions (a claim of $10,000.00 and under) we require a retainer to cover court costs. l For Ontario General Division Court action (claims over $10,000.00) the client will be advised of the retainer required to cover both court costs and time to execute on your claim. We are also able to provide the same quality of service for matters that have a jurisdiction outside of Ontario or outside of Canada. |
